Terms of Service

1. Acceptance of Terms

By accessing or using TimeMappr at timemappr.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all visitors, registered users, and others who access or use the Service.

2. Description of Service

TimeMappr is a web-based tool that allows individuals and teams to visualize working-hour overlaps across different timezones. The Service enables you to create teams, add members with their respective timezones and availability schedules, and view a timeline showing when team members are simultaneously available.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Accounts

4.1 Registration

You may use certain features of the Service as an anonymous guest. To access the full feature set, you must create an account by providing a valid email address and password, or by authenticating via a supported third-party provider (e.g., Google).

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@timemappr.com of any unauthorized use of your account. We are not liable for any loss or damage resulting from your failure to protect your credentials.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if you violate these Terms or engage in conduct we determine to be harmful to the Service or other users.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Upload or transmit any content that is unlawful, harmful, defamatory, or offensive.
• Attempt to gain unauthorized access to the Service, its servers, or related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Scrape, crawl, or otherwise extract data from the Service without written permission.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the Service to send unsolicited communications (spam).

6. User Content

You retain ownership of any data you submit to the Service, including team names, member names, and schedule information ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to store and process that content solely for the purpose of providing the Service to you.

You represent and warrant that you have all rights necessary to submit User Content and that it does not violate the rights of any third party.

7. Intellectual Property

The Service, including its design, software, trademarks, and content (excluding User Content), is owned by TimeMappr and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described therein.

9. Third-Party Services

The Service integrates with third-party providers including Google Firebase for authentication and data storage. Your use of those services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of any third-party service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Timezone offset data is provided for informational purposes only. TimeMappr does not guarantee the accuracy of timezone calculations and is not liable for scheduling errors arising from reliance on the Service.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TIMEMAPPR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless TimeMappr and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service (or any part thereof) at any time with or without notice. We may also revise these Terms at any time by posting the updated version on this page with a new effective date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property disputes.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TimeMappr regarding the Service and supersede all prior agreements and understandings.
